Biography

Mr. Day is a graduate of the renowned Strauss Institute for Dispute Resolution and Principal of Day Resolutions, practicing exclusively mediations and arbitrations. Over the past twenty years, Mr. Day has heard hundreds of cases with an extraordinarily high success rate.

Mr. Day was, for 25 years, the principal of the Tustin firm of Day, Day & Brown, practicing in the field of medical, dental and legal malpractice and serious personal injury. Mr. Day is a frequent arbitrator in both civil and fee dispute matters, and has served as an arbitrator for both the Orange County Superior Court and the Orange County Bar Fee Dispute Committee for more than twenty (20) years. Mr. Day is a member of the American Board of Trial Advocates (ABOTA), is Past President of the Orange County Chapter of ABOTA, and is board-certified as a Civil Trial Advocate by the National Board of Trial Advocacy. Mr. Day was elected the 2007 President of CAL-ABOTA, which is comprised of all eight (8) California chapters of ABOTA. He is a former Vice-Chair of the Bar’s Client Relations Committee which reviews ethical complaints against lawyers and takes appropriate action. He is both an Arbitrator and Temporary Judge for the Orange County Superior Court, and serves as Special Deputy Trial Counsel and Special Master for the California State Bar, and lectures for Continuing Education of the Bar on professional negligence. He has served as an adjunct professor of Torts and Remedies at Western State University College of Law and was one of a handful of graduates to be inducted into the University’s Hall of Fame.

Mr. Day has tried numerous cases to verdict in Superior Courts in California, has obtained many sevenfigure verdicts and settlements on behalf of his firm’s clients, and has successfully prosecuted many appeals, including a precedent-setting decision regarding professionalism and ethics, and the court’s duty to consider the parties’ intent when interpreting statutory offers to compromise. [DeRose v. Heurlin (2002) 100 Cal.App.4th 158]. Mr. Day has successfully prosecuted the appeal (and underlying badfaith case) of Romano v. Mercury Insurance Company, (2005) 128 Cal.App.4th 1333, a landmark decision which forced California insurers to change their handling of uninsured motorist claims where the responsible party’s insurance carrier was insolvent.

Mr. Day is listed in the 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2012 and 2013 editions of “Best Lawyers in America” and the 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2012 and 2013 editions of “Southern California Super Lawyers.”
