Biography |
For over thirty years Tom has tried complex commercial cases throughout the State of Texas. He became Board Certified in Civil Trial law after only 8 years of practice and has maintained that certification for the 20+ years since that time.
His success has earned him recognition as a Texas Super Lawyer in Business Litigation from the inception of that designation in 2003 through the present and he is also a Best Lawyer in America in Commercial Litigation. Tom’s practice has included trying multiparty cases to verdict, in state and federal court in Texas and beyond, as well as handling arbitrations involving claims based on: business torts, fraud, fiduciary duty, unfair competition, antitrust, conversion, embezzlement, intellectual property, professional negligence, accountant malpractice, breach of contract, licensing, oil and gas disputes, securities law violations, corporate governance, and workplace violations. His practice has been on both sides of the docket for clients large and small and has included numerous defense verdicts and multimillion-dollar, actual and punitive damages verdicts for plaintiffs.
Tom has routinely handled his own appeals, as well. For most commercial trial practices, trial is the exception and settlement the norm. As result, Tom has extensive experience in settling complex cases, frequently through one of the many forms of Alternate Dispute Resolution. The nature of his docket has quite often required creative settlements that involve business transactions in addition to or in lieu of the transfer of money. Tom also brings business acumen to his mediation and arbitration practice. In addition to his law practice for clients, he has had ten years of experience as the Managing Partner of a large highlyrespected law firm in Austin, Texas. In that role he had active involvement in, and oversight of, all management functions, including: finance, reporting, cost control, client relations, policymaking, compensation, attorney recruiting and training, human resources, professional and regulatory compliance, and consensus building. These management skills have enhanced his ability to better understand real life concerns of business leaders and to devise creative, yet workable solutions to commercial disputes.
